Terms of Service

1. Service description

26 Connect is a voice-over-IP (VoIP) service that lets you place and receive voice calls, exchange text messages (SMS), and manage voicemail from a Canadian or US phone number assigned to you. The service runs on our FusionPBX platform and our partner Telnyx's network.

2. Eligibility and registration

You must be at least 18 years old, or a legally constituted entity, to use 26 Connect. You are responsible for the accuracy of the information provided at signup and for keeping your password confidential.

3. Plans and billing

Plans are listed in the app and include a number of user extensions plus included minutes per monthly billing cycle. Payments are processed by Moneris in Canadian dollars.

• Billing is monthly and renews automatically.
• Unused minutes do not carry over to the next month.
• Calls beyond included minutes are billed at the rate shown at the time of the call.
• Applicable federal and provincial taxes are added to the invoiced amount.
• Plan changes take effect at the next billing cycle unless we indicate otherwise.

Refunds

Monthly payments already processed are non-refundable, except for a billing error or an extended service outage attributable to 26 Telecom.

Suspension for non-payment

We may suspend the service if a payment fails for more than 7 days. Phone numbers may be released after 30 days of suspension.

4. Acceptable use

You agree not to use 26 Connect to:

• send unsolicited bulk communications (spam, robocalls);
• impersonate another person or spoof caller ID;
• commit unlawful acts, including fraud, harassment, or threats;
• transmit content that infringes copyrights, trademarks, or trade secrets;
• bypass technical protections of the service or attempt to access accounts you do not own.

Breach of these rules may lead to immediate termination of your account without refund. We reserve the right to report illegal activity to the competent authorities. See also our Acceptable Use Policy.

5. Phone numbers

Numbers assigned to you remain the property of 26 Telecom. You receive use of them for the duration of your subscription. Upon termination, a number may be recycled after a regulatory delay.

Portability: outbound number portability is available under CRTC and FCC rules. Administrative fees may apply.

6. Service availability

We target 99.5% monthly uptime. Outages, maintenance windows, or failures of third-party providers (Telnyx, Apple, Google) may temporarily interrupt the service. We do not guarantee availability for 911 or 112 emergency calls.

7. Intellectual property

The app, its code, trademarks, design, and documentation are the exclusive property of 26 Branding Agency Inc. You receive a limited, non-exclusive, revocable license to use the app for its intended purposes.

8. Limitation of liability

To the maximum extent permitted by law, 26 Telecom is not liable for indirect losses, lost revenue, data loss, or damages arising from:

• service interruption;
• inability to reach emergency services;
• use not compliant with these terms;
• actions of a third party (Telnyx, Apple, Google, Moneris, internet service provider).

26 Telecom's total liability for any claim is limited to the amount you paid in the previous 12 months.

9. Termination

You can cancel your account at any time by writing to us via our contact form. Cancellation takes effect at the end of the current billing cycle. We may terminate your account for material breach of these terms.

10. Governing law and jurisdiction

These terms are governed by the laws of Quebec and applicable Canadian federal laws. Disputes are submitted to the courts of the judicial district of Montreal unless a mandatory law provides otherwise.

11. Changes

We may modify these terms. Material changes will be communicated at least 30 days before they take effect. Continued use of the service after the effective date means acceptance.
